Wrongful Termination

Wrongful Termination Lawyers
Whistleblower Retaliation
Most employees are employed "at will." This means workers can be terminated for any reason — or for no reason.
Discrimination
There are some important exceptions, however. You cannot be terminated because of your gender, age, race, ethnic background, religion or because of a disability or pregnancy. This is a federal crime under the Civil Rights Act, handled through the EEOC (Equal Employment Opportunity Commission) or the CCRD (Colorado Civil Rights Division).
Whistleblowing Retaliation
You also cannot be terminated because you reported illegal conduct to your employer or authorities, or as reprisal for refusing to participate in unlawful activities in the performance of your job. Whistle blowers are protected by federal and state statutes. You may be eligible for punitive damages if your employment ended because of retaliation and you can demonstrate you were injured economically and/or emotionally.
Other Discrimination
You also cannot be terminated (or disciplined) for any of the following reasons:
- Filing a workers' compensation claim
- Exercising your constitutional rights
- Jury duty, subpoenaed testimony, military service (National Guard) or any other government obligation
- Reporting health code violations
When you talk with us, we will ask what reason was given for the termination and what you think the real reason was. You have two years after the firing to file a wrongful employee termination suit in state court.
Elwyn F. Schaefer & Associates is an experienced employment discrimination law firm which can explain your rights and examine the facts of your case.
